M.B. v. Dep't of Children & Families, 2D05-4612

An order declaring a father's two children dependent as to him is reversed where the Department did not present any evidence that the father posed a present threat of harm to the children, the situation that gave rise to earlier domestic violence no longer existed, and the children were not exposed to a present threat of harm by continued acts of domestic violence.
