District Court of Appeal of Florida

Green v. APAC-Florida, Inc., 2D05-1569

In a personal injury suit, summary judgment for defendant pursuant to a conclusion that it was plaintiff's statutory employer and, thus, immune from suit under the workers' compensation statute is reversed where genuine issues of material fact remained for trial as to whether there was a sufficient nexus between an employer's services for a government contractor and a government project to support a finding that the contractor was plaintiff's statutory employer.
