District Court of Appeal of Florida
Reiser v. Wachovia Corp., 5D06-279
In a suit brought by a customer against a bank claiming that he sustained psychological injuries as a result of a bank robbery that could have been prevented had the bank not been negligent in providing security, summary judgment for the bank is affirmed because Florida does not recognize a cause of action for negligent infliction of emotional distress, at least in the absence of a physical impact or injury.
