District Court of Appeal of Florida
Berg v. Wagner, 4D05-2291
In a homeowner's association dispute brought by an association against a member seeking to foreclose upon certain liens, summary judgment in favor of the individual directors is affirmed in part and reversed in part where, although summary judgment could not be sustained on the grounds of the immunity afforded the directors by Florida Statutes section 617.0834, summary judgment was proper to an extent due to the running of the relevant statute of limitations.
