All in the Family Moving & Storage, Inc. v. Latka, 1D05-3073
A judgment pursuant to a jury trial against a common carrier awarding damages sustained in connection with an interstate move of plaintiffs' belongings and attorney's fees is affirmed where the carrier could not claim that the shippers were not entitled to attorney's fees under the Carmack Amendment where it failed to inform the shippers of their right to arbitration, and the shippers were unaware of that right until well after they had commenced their action.
