District Court of Appeal of Florida

Judgment notwithstanding verdict (JNOV) entered in a dental malpractice action in favor of defendant is reversed and remanded with directions that the verdict for plaintiff be reinstated where plaintiff's inconsistent pretrial representations, even if intentional, did not require the entry of the JNOV.
