District Court of Appeal of Florida

S. Riverwalk Invs., LLC v. City of Fort Lauderdale, 4D03-2781

Dismissal with prejudice of plaintiffs' complaint for declaratory judgment to determine the status of their site plan application for a development project is reversed where a complaint sufficiently alleged that a city initiated the process of amending its comprehensive plan, and plaintiffs had a right to have determined the present status of their application in light of the city's amendment plans.
