Levine v. Hunt, 2D05-1872

In a case arising from plaintiff's arrest at a city council meeting, an order dismissing a malicious prosecution claim against a city manager with prejudice is reversed where the dismissal was based upon an erroneous legal assumption that an arrest without further prosecution could not support a claim for malicious prosecution.
