District Court of Appeal of Florida

Obas v. State of Florida, 4D05-1088

A conviction for tampering with evidence is reversed since defendant's motion for judgment of acquittal should have been granted under circumstances where an officer was about to stop defendant, who was on a bicycle, defendant opened a container, dropped cocaine rocks on the ground, tossed the container five feet, and both were easily found.
