District Court of Appeal of Florida

In a survival action on brought on behalf of plaintiff's deceased wife, dismissal of an intentional infliction of emotional distress claim and the remaining counts in plaintiff's complaint as barred by worker's compensation immunity is reversed pursuant to the decision in Aguilera v. Inservices, 905 So. 2d 84, 93 (Fla. 2005).
