Summary judgment against plaintiff, a decedent's personal representative, in his action seeking damages arising from the death which allegedly was caused by a detective's tortious conduct is reversed where defendant failed to carry its burden of demonstrating conclusively either the absence of any genuine issue as to any material fact or entitlement to judgment as a matter of law.
