A trial court's determination that an insurer was entitled to its defense costs, fees, and expenses that it incurred while defending an insured in a patent infringement and unfair competition action is affirmed where it was determined that the insurer never had a duty to defend, and under the circumstances, it was entitled to reimbursement.
