Lundy v. Four Seasons Ocean Grand Palm Beach, 1D05-0109
An order of a judge of compensation claims denying stipulated attorney's fees as being in excess of the fees permitted by Florida Statutes section 440.34(1) and approving a fee permitted by the statute is affirmed over claims of error regarding: 1) construction of the statute at issue; 2) the propriety of approving the parties' agreement pursuant to Spitzer v. Bartlett Bros. Roofing, 437 So. 2d 758 (Fla. 1st DCA 1983); and 3) the constitutionality of the statute.
