McFadden v. Alliance Med. Practices, Inc., 1D05-4291

Grant of defendants' motion to enforce a settlement agreement and a requirement that plaintiff sign a general release is reversed where there was a material dispute regarding whether plaintiff's attorney had authority to enter into the settlement agreement, and an evidentiary hearing should have been held on the matter. Further, dismissal of plaintiff's complaint with prejudice is reversed where there was no finding that plaintiff's non-compliance with an order was willful or that less drastic remedies were not available.
