District Court of Appeal of Florida
Wyatt v. Milner Document Prods., Inc., 4D05-2686, 4D05-3338
In a dispute over a trial court's division of plaintiff's attorneys' fees between attorneys in underlying personal injury litigation, orders granting a motion to tax prejudgment interest against an attorney and denying a motion to tax costs against the attorney are reversed where the trial court erred in awarding prejudgment interest where funds were placed in an escrow account under court control, the prejudgment interest was not timely requested, and the trial court abused its discretion in failing to tax costs.
