District Court of Appeal of Florida

Hamilton v. Ford Motor Co., 4D04-4955

In an action alleging claims under the Florida Lemon Law Act and the Magnuson-Moss Warranty Act, an attorney's fees judgment is reversed in part pursuant to plaintiffs' claims that: 1) the trial court erred in relying on an improperly filed offer of judgment and improperly admitted expert testimony in deciding the amount of attorney's fees; 2) that the Magnuson-Moss Warranty Act entitled them to attorney's fees incurred in litigating the fee issue; 3) that costs should have been awarded.
