District Court of Appeal of Florida

Youngblood v. State of Florida, 2D05-3934

Summary denial of defendant's motion for postconviction relief seeking to withdraw his guilty plea because the length of his prison term was misrepresented to him at sentencing is reversed since defendant's failure to file a timely rule 3.170(l) motion did not prevent his involuntary plea claim from being raised in a rule 3.850 motion, and the record suggested that defendant was entitled to relief.
