Houston v. State of Florida, 5D06-1397

Summary denial of a motion for postconviction DNA testing brought by a defendant convicted of sexual battery is affirmed where the trial court properly held that: 1) defendant failed to abide by the applicable pleading requirements; and 2) because there was no dispute that defendant had sex with the victim, DNA testing would not exonerate him or mitigate his sentence.
