Fencher v. State of Florida, 5D05-1463

Convictions and sentences for sexual battery with a deadly weapon or physical force, burglary of a dwelling with an assault or battery with a firearm, and kidnapping with intent to commit a felony are affirmed over claims the trial court erred when it allowed the admission of a rape kit into evidence without testimony of a nurse who collected the samples, and by limiting his counsel's closing argument.
