Coastal Inv. Props., Ltd. v. Weber Holdings, LLC, 4D05-1085

Summary judgment and an attorney's fee award for defendant on its counterclaim for fraud, negligent misrepresentation, breach of warranty, and indemnification in connection with plaintiffs' sale of real property to it is reversed where summary judgment was inappropriate on the fraud claim, and there were genuine issues of material fact as to whether plaintiffs should have known of certain fire code violations and whether defendant justifiably relied on any of plaintiffs' statements.
