District Court of Appeal of Florida

Weber v. Weber, 2D05-4162

A husband's petition for a writ of prohibition or certiorari challenging a circuit court's order finding that it had subject matter jurisdiction to proceed with a dissolution action is denied over a claim that the circuit court lacked subject matter jurisdiction over the divorce because the wife's status as a nonimmigrant alien prohibited her from claiming that Florida was her "residence" for the requisite time period.
