Gillis v. State, 3d04-2340

Conviction for second degree murder and armed robbery is affirmed over evidentiary claims where: 1) unnecessarily suggestive identification procedures did not create a likelihood of irreparable misidentification; 2) Miranda warnings were not defective; and 3) a public jail cell does not have a high degree of privacy for Fourth Amendment purposes.
