Henao v. Prof'l Shoe Repair, Inc., 5D05-2348

A complaint which seeks enforcement of a covenant not to compete, executed by the buyer of a business in favor of the seller, states a viable cause of action. A restrictive covenant which otherwise satisfies the dictates of Florida Statutes section 542.335 is not unenforceable because it constitutes a restraint on the buyer of a business or shares of a corporation.
