District Court of Appeal of Florida
Bartlett v. State of Florida, 4D05-2232
A conviction of felony cruelty to animals is affirmed where the evidence supported defendant's conviction for shooting an opossum with a BB gun since the criminal statute at issue does not require an intent to cause the cruel death of an animal, but only an intent to commit an act that results in the cruel death.
