District Court of Appeal of Florida

B.B. v. P.J.M., 1D05-0510

An order of adoption, entered without the biological father's consent, is reversed where the child at issue had been "established by court proceeding" to be appellant-father's child, the father's parental rights had not been terminated, and thus, state law required the father's consent prior to the adoption of the child by her maternal grandparents.
