Gillen v. State of Florida, 4D05-215, 4D05-1861

A determination that defendant violated his probation by loitering and giving a law enforcement officer a false birth date is reversed where there was no evidence that defendant was loitering, and consequently, he was not lawfully detained and no violation for giving an officer a false date of birth occurred.
