Hutchinson v. Plantation Bay Apartments, LLC, 1D05-1679

Dismissal with prejudice of plaintiffs' suit alleging premises liability, failure to warn, and loss of consortium and an order denying a plaintiff's motion to enforce defendant's settlement proposal are affirmed where the sanction of dismissal with prejudice was not an abuse of discretion due to: 1) plaintiffs' intentionally false and misleading answers during discovery; 2) fraud relating to a dog attack; and 3) plaintiff's medical history.
