District Court of Appeal of Florida

Morales v. Marques, 5D05-4295

Dismissal of a complaint for legal malpractice against an attorney who represented plaintiffs in a suit against a fast food restaurant for alleged racial discrimination is affirmed on the ground that plaintiffs could not prove damages because the statute of limitations on the underlying claim had not yet run; defendant's motion for appellate attorney's fees is granted as the appeal was frivolous.
