Ginsberg v. ChemMed Corp., 1D05-3832

In a workers' compensation case, denial and dismissal of pending claims on statute of limitations grounds is reversed where a judge of compensation claims erred by basing the date the statute began to run on the date claimant was prescribed pain medication as remedial treatment for his compensable injury, and instead should have used the date claimant finished a course of treatment by taking a last dose of medication within the time prescribed.
