District Court of Appeal of Florida

Resendes v. Bradshaw, 4D06-1503

A petition for writ of habeas corpus challenging a setting of "no bond" on a charge of burglary of a dwelling at petitioner's first appearance is granted where the state did not seek pretrial detention, and in any event, the lower court failed to comply with a procedural and statutory requirement of specific findings of fact to support a pretrial detention ruling.
