District Court of Appeal of Florida

Murray v. Rosati, 4D04-3426

An appeal from an order denying defendants' renewed motions for directed verdict in a 42 U.S.C. section 1983 civil rights suit is dismissed for lack of jurisdiction where the trial court did not decide the issue of immunity as a matter of law, and its orders contained no specific language determining as a matter of law that defendants were not entitled to immunity.
