Smith v. State of Florida, 4D04-3709

A conviction and sentence for possession of cocaine and drug paraphernalia is affirmed over a claim of erroneous denial of a motion to suppress where an officer witnessed an assault perpetrated by defendant who was armed with a stick, and thus, there was reasonable suspicion that defendant was armed and the officer's weapons pat-down of appellant was proper.
