A judgment in favor of plaintiffs in a controversy concerning the rights to mine fill dirt from property in which plaintiffs and defendant all claimed some interest is reversed where the trial court abused its discretion in permitting an amendment to the pleadings during trial, and reformation of a deed was not permissible as a matter of law.
