District Court of Appeal of Florida

Herman v. State Farm Mut. Auto. Ins. Co., 2D05-1000

Summary judgment for an insurer finding that plaintiffs' claim for uninsured motorist benefits was barred by a Georgia two-year statute of limitations applicable to personal injury actions is reversed since controlling case law held on similar facts that Florida's four-year statute would apply.
