Faskowitz v. Dep't of Legal Affairs, 2D04-1311

A probate order determining heirs and directing that one-half of the property of an estate be deposited with the clerk of court is reversed in part where the trial court erred in determining that one-half of an estate was subject to the provisions of Florida Statutes section 733.816 since there was no basis for escheat of property as lawful heirs had established their status under applicable law.
