District Court of Appeal of Florida

Roberts v. State of Florida, 5D05-385

Defendant's convictions and sentences for attempted voluntary manslaughter with a weapon and attempted felony battery with a weapon is affirmed over a claim that the trial court erred in failing to grant a motion for mistrial, and in sentencing him under a firearm reclassification statute, and then as an habitual felony offender.
