Sweet v. Sheehan, 2D04-2744

Summary judgment for defendant-psychiatrist in a medical malpractice suit arising out of plaintiff-patient's failed suicide attempt is reversed where: 1) the trial court erred in finding that defendant owed no duty to plaintiff; and 2) defendant failed to demonstrate the absence of a genuine issue as to both "the standard of care required and observed," and to establish that plaintiff could not show causation.
