Dames v. 926 Co., Inc., 4D05-372

Denial of tenants' claim for apportionment of proceeds paid to a property owner following an exercise of eminent domain powers and a taking of the property is reversed where: 1) plaintiffs held a leasehold interest in the property at issue; 2) neither a claimed abandonment nor a foreclosure action justified a failure to compensate plaintiffs; and 3) the trial court erred in striking expert testimony.
