District Court of Appeal of Florida

M.W. v. State of Florida, 1D05-3543

Commitment of a juvenile to a moderate risk residential facility is reversed where the trial court failed to reference the characteristics of the restrictiveness level vis-a-vis the needs of the child when deviating upward from a recommendation of probation, and made no finding that defendant's behavior constituted a danger to society.
