District Court of Appeal of Florida

Cabrera v. Pazos, Larrinaga & Taylor, P.A., 2D04-2441

Dismissal of a complaint for lack of prosecution is reversed where the trial court abused its discretion in the dismissal when it relied upon its customary practice which placed the burden upon the parties to set cases on the trial docket, and plaintiff had filed his notice for jury trial.
