Gallo v. Brady, 4D04-3571

Summary judgment for defendants in a legal malpractice claim involving services rendered in connection with estate planning is reversed where a jury could reasonably find that one of the purposes for establishing a charitable trust was to effectuate federal tax savings, and state law did not prohibit resort to extrinsic evidence under the circumstances.
