An order awarding attorneys' fees to defendant in a case involving defendant's attempt to foreclose on a mortgage and recover damages due under a promissory note is affirmed since, despite defendant's failure to plead entitlement to attorney's fees, plaintiff was clearly on notice of defendant's attorneys' fee claim.
