District Court of Appeal of Florida

Rose v. Fiedler, 4D01-2856

Order directing a verdict against medical malpractice plaintiff and in favor of defendant physicians as a sanction for her trial counsel-s misbehavior is affirmed pursuant to the supreme court's disapproval of a decision determining that a client's participation in the misconduct was required as a prerequisite to the imposition of a sanction as severe as dismissal.
