District Court of Appeal of Florida

MacDonald v. Mauriello, 2D04-3853

A probate court order precluding an estate's representative from expending estate monies to prosecute appeals stemming from a wrongful death suit brought by another estate's representative is reversed where the probate court erred in requiring the representative to show a monetary benefit to the estate before he would be entitled to reimbursement for appellate expenses.
