Schroeder v. Lawhon, 2D05-194

An order for the partition in kind of real property in a dispute between siblings is reversed in part where plaintiff-sister failed to carry her burden of proof on her objection to a recommendation of partition commissioners, and where the trial court erred in requiring defendant to pay a disproportionate share of past real estate taxes.
