District Court of Appeal of Florida

Tolbert v. State of Florida, 5D04-2785

Defendant's conviction for home invasion robbery with a firearm and related offenses is affirmed over his claims of error that insertion of "and/or" between his name and the name of his codefendant in jury instructions allowed a jury to wrongfully convict him, and that the trial court erred in allowing certain evidence to be presented to a jury.
