District Court of Appeal of Florida

State of Florida v. Gonzales, 5D05-348

Order granting defendant's motion to suppress an identification card in a prosecution for knowing possession of a blank, forged, stolen, fictitious, counterfeit or unlawfully issued identification is reversed where defendant's encounter with an officer was consensual, and thus, the officer did not need to have a reasonable suspicion of criminal activity to request that defendant produce identification.
