Evans v. Tradestation Group, Inc., 4D04-3287

Summary judgment for defendant, former employer, enforcing a non-compete contract involving trade secrets is reversed where the issue of whether plaintiff-employee was entitled to be paid for not competing could not be properly resolved by summary judgment, and factual issues remained as to whether the employer anticipatorily breached, or acted in good faith in taking a position that a payment-not-to-compete provision did not apply.
