US Holdings, Inc. v. Belance, 3D04-872

Order denying appellant-defendant's motion for summary judgment, finding that it is not entitled to workers' compensation immunity, is affirmed where, as a matter of law, it is not entitled to the statutory immunity found in section 440.11(3), Florida Statutes (1997), because it was sued in its capacity as the owner of allegedly defective and dangerous premises.
