District Court of Appeal of Florida

Graves v. State of Florida, 4D05-2804

Conviction and sentence is reversed and remanded where: 1) the court's self-defense instructions were erroneous because they were reasonably calculated to mislead/confuse the jury as, in a single aggravated battery case, jury instructions that appellant's use of force was not justifiable if he was committing or attempting to commit an aggravated battery is fundamental error; and 2) the court committed reversible error in not allowing testimony showing the bias of a witness.
